This may be ufair but probably not illegal. I believe it is federal labor law that employers with who have only a certain number of employees (I think 12-the number may be as high as 30-answer should be one the web somewhere) are exempt from FMLA compliance. If this was a small practice they might not be obligated to honor FMLA protections.
